هذه الاتفاقية ("الاتفاقية") هي عقد قانوني بينك ("المستخدم" أو "أنت") وبين ITSpectrum ("الشركة" أو "نحن" أو "لنا")، وهي تحكم استخدامك لتطبيق AynIQ ("التطبيق") المتوفر عبر متجر تطبيقات Apple.

من خلال تنزيل أو تثبيت أو استخدام AynIQ، فإنك توافق على الالتزام بشروط هذه الاتفاقية. إذا كنت لا توافق على هذه الشروط، يرجى عدم استخدام التطبيق.

1. منح الترخيص

بموجب امتثالك لهذه الاتفاقية، تمنحك ITSpectrum ترخيصًا محدودًا وغير حصري وغير قابل للتحويل وقابل للإلغاء لتنزيل وتثبيت واستخدام AynIQ على أي جهاز من أجهزة Apple التي تمتلكها أو تتحكم فيها، وفقًا لقواعد الاستخدام الخاصة بمتجر التطبيقات.

 

2. قيود الترخيص

أنت توافق على عدم القيام بأي مما يلي:

• تعديل أو إجراء هندسة عكسية أو تفكيك أو إعادة تجميع التطبيق.

• تأجير أو تأجير فرعي أو إقراض أو بيع أو إعادة ترخيص أو توزيع التطبيق.

• استخدام التطبيق بطريقة غير قانونية أو غير مصرح بها.

• التدخل في ميزات الأمان الخاصة بالتطبيق أو تعطيلها.

• استخدام التطبيق لجمع أو معالجة البيانات الشخصية بما ينتهك قوانين الخصوصية المعمول بها.

3. جمع بيانات الموقع والخصوصية

يجمع AynIQ بيانات موقعك في الوقت الفعلي ويعالجها لمساعدتنا على تحديد موقعك بأقصى دقة ممكنة في حالات الطوارئ. يتم ذلك لتعزيز سلامتك وضمان تقديم المساعدة بسرعة عند الحاجة.

باستخدامك لـAynIQ، فإنك توافق على جمع ومعالجة ومشاركة بيانات موقعك حصريًا للاستجابة لحالات الطوارئ وتحسين الخدمات.

يتم التعامل مع جميع البيانات الشخصية، بما في ذلك معلومات الموقع، وفقًا لسياسة الخصوصية الخاصة بنا (http://itspectrum.ae/ayniq-eula). نحن لا نبيع أو نشارك بيانات الموقع مع أطراف ثالثة غير مصرح لها.

 

4. الملكية والملكية الفكرية

يظل تطبيق AynIQ، بما في ذلك جميع المحتويات والعلامات التجارية والتكنولوجيا الخاصة، ملكية حصرية لشركة ITSpectrum والجهات المرخصة التابعة لها. لا تحصل على أي حقوق ملكية للتطبيق باستثناء الترخيص المحدود الممنوح لك بموجب هذه الاتفاقية.

 

5. التحديثات والدعم

قد نقوم بتوفير تحديثات أو تحسينات أو إصلاحات أخطاء لتطبيق AynIQ. قد يتم تثبيت التحديثات تلقائيًا دون إشعار مسبق. نحتفظ بالحق في تعديل أو إنهاء دعم التطبيق في أي وقت.

6. إنهاء الترخيص

يظل هذا الترخيص ساريًا حتى يتم إنهاؤه. سيتم إنهاء حقوقك بموجب هذه الاتفاقية فورًا إذا انتهكت أيًا من الشروط. عند الإنهاء، يجب عليك حذف جميع نسخ التطبيق من أجهزتك.

 

7. إخلاء المسؤولية عن الضمان

يتم تقديم AynIQ "كما هو" و"كما هو متاح" دون أي ضمانات من أي نوع. إلى أقصى حد يسمح به القانون، تخلي ITSpectrum مسؤوليتها عن جميع الضمانات، بما في ذلك الضمانات الضمنية لقابلية التسويق والملاءمة لغرض معين وعدم الانتهاك.

لا تتحمل Apple أي مسؤولية عن أي مطالبات تتعلق بـAynIQ، بما في ذلك مطالبات مسؤولية المنتج أو عدم الامتثال للمتطلبات القانونية أو انتهاك حقوق الملكية الفكرية.

 

8. تحديد المسؤولية

إلى أقصى حد يسمح به القانون، لن تكون ITSpectrum مسؤولة عن أي أضرار غير مباشرة أو عرضية أو تبعية أو خاصة تنشأ عن استخدامك لـAynIQ.

 

9. شروط الأطراف الثالثة

قد يدمج AynIQ خدمات من أطراف ثالثة. باستخدام هذه الخدمات، فإنك توافق على الامتثال لشروطها.

 

10. علاقة Apple

تُعتبر Apple والشركات التابعة لها أطرافًا مستفيدة من هذه الاتفاقية. بمجرد موافقتك على هذه الشروط، يكون لـApple الحق في إنفاذ هذه الاتفاقية ضدك كمستفيد طرف ثالث.

 

11. الامتثال لقوانين التصدير

لا يجوز لك استخدام أو تصدير AynIQ بما ينتهك أي قوانين سارية، بما في ذلك قوانين مراقبة التصدير الأمريكية والدولية.

 

12. القانون الحاكم وحل النزاعات

تخضع هذه الاتفاقية لقوانين العراق، باستثناء مبادئ تعارض القوانين. يتم حل أي نزاعات من خلال التحكيم أو المحاكم الواقعة في العراق.

END USER LICENSE AGREEMENT (EULA)

​

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and ITSpectrum (“Company,” “We,” “Us,” or “Our”), governing your use of the AynIQ software application (“AynIQ” or the “App”) provided via the Apple App Store.

By downloading, installing, or using AynIQ, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, please do not use the App.

 

1. LICENSE GRANT

Subject to your compliance with this Agreement, ITSpectrum grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use AynIQ on any Apple-branded device that you own or control, as permitted by the App Store’s Usage Rules.

 

2. LICENSE RESTRICTIONS

You agree not to:

• Modify, reverse-engineer, decompile, or disassemble the App.

• Rent, lease, lend, sell, sublicense, or distribute the App.

• Use the App in any unlawful or unauthorized manner.

• Interfere with or disrupt the App’s security features.

• Use the App to collect or process personal data in violation of applicable privacy laws.

 

3. LOCATION DATA COLLECTION & PRIVACY

AynIQ collects and processes your real-time location data to help locate you as accurately as possible in emergency situations. This is done to enhance user safety and ensure rapid assistance when needed.

By using AynIQ, you consent to the collection, processing, and sharing of your location data strictly for emergency response and service improvements.

All personal data, including location information, is handled in accordance with our Privacy Policy (http://itspectrum.ae/ayniq-eula). We do not sell or share location data with unauthorized third parties.

 

4. OWNERSHIP & INTELLECTUAL PROPERTY

AynIQ, including all content, trademarks, and proprietary technology, remains the exclusive property of ITSpectrum and its licensors. You obtain no ownership rights to AynIQ other than the limited license granted.

 

5. UPDATES & SUPPORT

We may provide updates, enhancements, or bug fixes to AynIQ. Updates may be automatically installed without prior notice. We reserve the right to modify or discontinue support for the App at any time.

6. TERMINATION

This license is effective until terminated. Your rights under this Agreement will terminate immediately if you violate any terms. Upon termination, you must delete all copies of AynIQ from your devices.

 

7. NO WARRANTY

AynIQ is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. To the maximum extent permitted by law, ITSpectrum disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Apple is not responsible for any claims related to AynIQ, including product liability claims, failure to meet legal requirements, or intellectual property infringement.

 

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ITSpectrum shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of AynIQ.

 

9. THIRD-PARTY TERMS

AynIQ may integrate third-party services. You agree to comply with their terms when using such services.

 

10. APPLE'S RELATIONSHIP

Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of these terms, Apple shall have the right to enforce this Agreement against you as a third-party beneficiary.

 

11. EXPORT COMPLIANCE

You may not use or export AynIQ in violation of any applicable laws, including U.S. and international export control laws.

 

12. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement is governed by the laws of Iraq, excluding conflicts of law principles. Any disputes shall be resolved through arbitration or courts located in Iraq.
